Terms & Conditions
These Terms & Conditions ("Terms") govern your access to and use of the websites, products and services of Malaya Digital, operated by MALAYA DIGITAL HUB (202603105413 / JM1043242-T) ("we", "us", "our"). By creating an account, purchasing, or using our services you agree to these Terms.
1. Services
We provide cloud-delivered software including the Predictive Dialer, WADigital Plus WhatsApp platform, Voice Broadcast, related credits and add-ons, and professional services. Features, limits and availability are described at the point of sale and may be updated from time to time.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and promptly update it. You must be authorised to bind your organisation when purchasing on its behalf.
3. Subscriptions & billing
- Subscriptions (monthly or annual) renew automatically until cancelled.
- Prices are in Malaysian Ringgit (MYR), and the total displayed at checkout is the amount charged.
- Predictive Dialer is licensed per agent seat ("User Fee") with a one-time setup fee. WhatsApp message credits and Voice Broadcast minutes are purchased as one-time usage top-ups.
- You authorise us and our payment processor (Stripe) to charge your payment method for all fees due.
4. Acceptable use
You agree not to use our services to send unlawful, deceptive, or unsolicited messages, to violate WhatsApp/Meta or telecommunications regulations, or to infringe the rights of others. You are responsible for obtaining valid consent from your recipients and for complying with all applicable laws, including the Malaysian Personal Data Protection Act 2010 (PDPA) and anti-spam rules. We may suspend services for violations.
5. Messaging & third-party platforms
WhatsApp broadcasting depends on third-party platforms (e.g. Meta/WhatsApp) and telecom carriers. Deliverability, template approval, number bans and rate limits are governed by those providers and are outside our control. Credits consumed for messages submitted are non-refundable.
6. WhatsApp platform compliance
If you use WADigital Plus or any WhatsApp broadcast functionality, you must comply at all times with the current WhatsApp Business Messaging Policy, WhatsApp Business Terms of Service, WhatsApp Messaging Guidelines, Meta policies, and all applicable laws.
Agreement to these Terms is also your agreement to follow those WhatsApp and Meta requirements when using our WhatsApp services. You must not use our system for any message, campaign, product, service, activity or purpose that violates or attempts to circumvent WhatsApp’s terms, policies, technical restrictions or enforcement measures. This obligation applies when you create an account, purchase credits, connect a number, launch a campaign or otherwise use the platform.
- You must provide and maintain your own valid WhatsApp Business Account (WABA), and only connect business numbers registered and approved for use with the official WhatsApp Business API.
- You may only contact recipients who have provided their mobile number and valid opt-in permission to receive the relevant category of messages or calls.
- You must promptly honour every request to opt out, block, discontinue, or otherwise stop receiving communications.
- Business-initiated messages must use approved templates where required, and templates may only be used for their approved purpose.
- You must not send spam, deceptive or unlawful content, prohibited goods or services, or content that infringes another person’s rights.
- You are responsible for the accuracy of your business profile, recipient lists, message content, consent records, and compliance evidence.
WhatsApp or Meta may reject templates, restrict messaging, suspend numbers, or terminate accounts for policy violations. We may also immediately suspend or terminate access to our platform where we reasonably believe these requirements have been breached or our system is being used to facilitate a WhatsApp policy violation. We are not responsible for third-party enforcement decisions, and credits or fees affected by a client’s non-compliance are non-refundable.
7. How data is handled
We process account information, usage records, uploaded contact lists, message content, campaign records and related service data only as reasonably necessary to provide, secure, maintain and support the services, process transactions, prevent misuse, and comply with legal obligations. Payment card information is processed by our payment provider and full card numbers are not stored on our servers.
You retain ownership of the contact lists, message content and other customer content you upload. For recipient data processed through our broadcast services, you are the data controller and we act as a data processor on your behalf. Access is limited to authorised personnel and service providers who require it to operate or support the services. We may transmit data to hosting, payment, analytics, telecommunications and messaging providers, including Meta/WhatsApp, as described in our Privacy Policy. We do not sell personal data.
8. Inactive data and dormant accounts
- Inactive service data: Uploaded contact lists, message content, campaign records and other operational customer content will be purged after ninety (90) consecutive days of inactivity. Inactivity means no login, campaign, message, upload or other use of the relevant service during that period.
- Dormant accounts: An account that remains dormant for six (6) consecutive months will be deleted. Dormancy means no login, active subscription, purchase, campaign, message or other platform activity during that period.
- Legal records: Billing, invoice, transaction, tax, security and compliance records may be retained for longer where required by law, for fraud prevention, dispute resolution or the establishment and defence of legal claims.
Purging or account deletion may be irreversible. You are responsible for exporting any data you need before the applicable inactivity or dormancy period expires. Purchasing credits does not override these retention periods unless there is subsequent platform activity.
9. Purchase of credits and acceptance
Each purchase or top-up of platform credits constitutes your express acceptance of the version of these Terms in effect at the time of purchase. By completing checkout, you confirm that you are authorised to make the purchase, understand the permitted use of the platform, and accept the data-retention, acceptable-use, WhatsApp compliance, billing and refund conditions stated in these Terms. This acceptance applies whether or not all purchased credits are later used.
10. Fees, refunds & cancellation
Fees are non-refundable except as described in our Refund Policy. In short, services are non-refundable once provisioned or used. You may cancel renewals at any time from your account.
11. Service availability
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages and force-majeure events may affect availability.
12. Intellectual property
All software, content and trademarks remain the property of their respective owners. We grant you a limited, non-exclusive, non-transferable right to use the services during your subscription. You retain ownership of your own data and contact lists.
13. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential losses, or for loss of profits, data or goodwill. Our total liability for any claim is limited to the fees you paid for the relevant service in the three (3) months preceding the claim.
14. Changes & governing law
We may update these Terms; material changes will be posted on this page with a revised date. These Terms are governed by the laws of Malaysia, and the courts of Malaysia have exclusive jurisdiction.
